New CMS Guidance on Immediate Jeopardy Meeting

On October 2, GNYHA will host a meeting at which the New York State Department of Health (DOH) and the Centers for Medicare & Medicaid Services (CMS) will review revised guidance in CMS’s State Operations Manual Appendix Q about what constitutes an immediate jeopardy (IJ) situation in a health care organization.

This meeting was originally scheduled for October 9.

Under the new CMS guidance, IJ is defined as a situation in which a recipient of care has suffered or is likely to suffer serious injury, harm, impairment, or death as a result of noncompliance, and represents the most severe and egregious threat to the health and safety of patients. It also carries the most serious sanctions for providers, suppliers, and/or laboratories. The revised Appendix Q-Core Guidelines will be used by state surveyors of all provider types, supplier types, and laboratories during health, emergency preparedness, and life safety code surveys.
